{"id":16466,"date":"2014-07-28T17:17:19","date_gmt":"2014-07-28T17:17:19","guid":{"rendered":"http:\/\/clekis.com\/?p=16466"},"modified":"2014-07-28T17:17:19","modified_gmt":"2014-07-28T17:17:19","slug":"person-dui-bicycle-south-carolina","status":"publish","type":"post","link":"https:\/\/themediabeast.com\/resources\/person-dui-bicycle-south-carolina\/","title":{"rendered":"Can a person get a DUI on a bicycle in South Carolina?"},"content":{"rendered":"<p>According to South Carolina law,\u00a0<span style=\"font-weight: bold; color: #000000;\">Title 56 &#8211; Motor Vehicles,\u00a0<\/span><span style=\"color: #000000;\">ARTICLE 23,\u00a0<\/span><span style=\"font-weight: bold; color: #000000;\">SECTION 56-5-2930.<\/span><span style=\"color: #000000;\">\u00a0Operating motor vehicle while under influence of alcohol or drugs; penalties; enrollment in Alcohol and Drug Safety Action Program; prosecution.\u00a0<\/span><\/p>\n<p><br style=\"color: #000000;\" \/><span style=\"color: #000000;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-16467 size-medium\" src=\"http:\/\/clekis.com\/wp-content\/uploads\/2014\/07\/Baldwin-Hills-Accident-Lawyers-300x178.jpg\" alt=\"drunk on a bicycle fail\" width=\"300\" height=\"178\" \/>(A) It is unlawful for a person to drive a motor vehicle within this State while under the influence of alcohol to the extent that the person&#8217;s faculties to drive a motor vehicle are materially and appreciably impaired, under the influence of any other drug or a combination of other drugs or substances which cause impairment to the extent that the person&#8217;s faculties to drive a motor vehicle are materially and appreciably impaired, or under the combined influence of alcohol and any other drug or drugs or substances which cause impairment to the extent that the person&#8217;s faculties to drive a motor vehicle are materially and appreciably impaired. A person who violates the provisions of this section is guilty of the offense of driving under the influence and, upon conviction, entry of a plea of guilty or of nolo contendere, or forfeiture of bail must be punished as follows:<\/span><\/p>\n<p>But what about a Bicycle? Well, according to this same section of the law,\u00a0<span style=\"font-weight: bold; color: #000000;\">SECTION 56-5-160,\u00a0<\/span>A bicycle is a device propelled solely by pedals, operated by one or more persons, and having two or more wheels, except childrens&#8217; tricycles.<\/p>\n<p>So, in fact, in the state of South Carolina, you cannot get a DUI for simply operating a bicycle.
