Personal Injury Lawyer\u00a0<\/a>|\u00a0Omar, a 32-year-old Uber driver, was working a typical late-night\u00a0shift in Los Angeles last month when his ride veered\u00a0from pleasant to violent in just a few minutes. When he pulled his\u00a0SUV full of passengers up to the Hollywood Tower apartments around 2:30 a.m., two of the riders\u00a0refused to leave his car. An\u00a0argument broke out, and Omar said\u00a0one of the passengers hit\u00a0him with a shiny object, broke\u00a0his jaw in two places and landed\u00a0him in the hospital for a week.<\/p>\n

Omar\u2019s not\u00a0the only worker to find\u00a0that a newfangled job like driving for Uber comes with some very old dangers: on-the-job injuries. On Sunday, an off-duty Boston cop\u00a0assaulted\u00a0his Uber driver, yelled\u00a0racial slurs at him and stole his car. In Los Angeles, people\u00a0stabbed an Uber driver in the face and neck\u00a0in November and\u00a0choked another driver\u00a0on New Year\u2019s Day, though in both cases the attacker was likely not the\u00a0passenger Uber assigned the driver. A San Francisco passenger\u00a0attacked\u00a0his Uber driver in November, landing him in the hospital with\u00a0facial injuries. A Lyft passenger\u00a0punched\u00a0his driver and broke his nose in May. And it\u2019s not just headline-grabbing assaults \u2014 if any Homejoy cleaner falls while mopping or any Instacart shopper throws out their back while carrying groceries, they\u2019re in the same boat.<\/p>\n

In each case, the injured worker\u00a0can\u2019t turn to the platform for a dime of help. As much as workers like Omar\u00a0may think of themselves as\u00a0employees of peer-to-peer marketplaces like Uber, Lyft, TaskRabbit, Instacart, Postmates or Homejoy, they\u2019re not, legally speaking. Companies are under no obligation to provide the same worker protections for independent contractors as\u00a0they are for employees \u2014 protections\u00a0like overtime, paid sick days, health insurance and workers\u2019 compensation.<\/p>\n

Two damaged teeth, one surgery\u00a0and a week-long hospital stay later, Omar, who didn\u2019t want to include his last name, is stuck with\u00a0sky-high medical bills and limited options. His only source of income is driving for Uber\u2019s high-end Black and SUV platforms \u2014 the Los Angeles police\u00a0investigative report\u00a0even lists his occupation as \u201cUber driver.\u201d He believes Uber should\u00a0help pay for some of his\u00a0bills \u2014 after all, he was hurt while on the job,\u00a0earning Uber commission money.<\/p>\n

But as an independent contractor, just like almost all workers in the sharing economy, Omar\u00a0isn\u2019t entitled to\u00a0workers\u2019 compensation, which is designed\u00a0to pay for work-related injuries and lost wages. To make matters worse, he doesn\u2019t have his own health insurance, despite the Affordable Care Act\u2019s individual mandate.<\/p>\n

Unlike employees, independent contractors are largely free to set their own hours, pick their own clients and control other aspects of their work.\u00a0In exchange, if they get hurt while working, whatever the reason, they\u2019re on their own. Some sharing-economy workers are experienced freelancers, but many \u2014 like Omar \u2014 have never before relied on\u00a0contract work for their full-time income, and they may not realize\u00a0the full stakes of the tradeoff.<\/p>\n

\u201cThey don\u2019t\u00a0have to show up to work on Monday at 9 a.m. if they don\u2019t want to,\u201d said Nick\u00a0Woodfield, an attorney with the Employment Law Group. \u201cWhat they\u2019re not understanding is that this lack of control \u2014 where they can have a two-hour lunch if they want, or no lunch at all \u2014 that freedom comes at the price of if they\u2019re in an accident, the company doesn\u2019t have to pay.\u201d<\/p>\n
