Age of Children

The “Tender Age Doctrine” was put into place to that essentially indicated that children of a younger age should always be in the custody of the mother. This made it nearly impossible for a man to ever retain his rights as a father and thus created the movement for men to fight for their rights to have visitation and in some cases custody of their children. It’s unfair and not always the best interest of the child to automatically be in the care of the mother. This isn’t to say that mothers should never have this right, but fathers should be evaluated equally.

Role of the Father

For years, the role of the father has primarily been evaluated based on his financial support of the child. While financial support is undoubtedly an essential factor when raising a child, much more goes into being a parent. Rather than evaluate the father’s parenting and role in the child’s life, frequently the court only examines the father’s ability (or inability) to pay child support.
